OKX Argentina Terms and Conditions of Giveaways on Social Media
These terms and conditions of the Social Media lucky draw (the “Terms”) are entered into between you (“user” or “you”) and StellarX Technology Company Limited. ("OKX," "we," "us," or "our")These Terms govern your access and participation in our social media lucky draws (the “Draws”) (collectively, the “Agreement” or "Terms").
No purchase necessary. Transactions, purchases, or payments of any kind will not increase your chances of winning. Participation is limited to legal residents in non-prohibited jurisdictions. OKX social media lucky draws are void where prohibited or restricted by law.
By entering the Lucky Draws, you confirm that you have read, understood, and accepted the Agreement, and will be legally bound by any and all of these Terms. If you do not agree to be bound by the Agreement, do not access or participate in the Lucky Draws.
OKX SOCIAL NETWORK LUCKY DRAWS ARE NOT AVAILABLE TO YOU, AND YOU MAY NOT PARTICIPATE IN OKX SOCIAL NETWORK LUCKY DRAWS IF YOU ARE LOCATED IN ANY OF THE RESTRICTED JURISDICTIONS LISTED IN SECTION 1.2.
1. Eligibility
1.1 Eligibility of the Participants. The lucky draws are open only to legal residents of Argentina, through which OKX may offer its Services to individuals who are at least 18 years of age or older. All participants must comply with this Agreement and all applicable Terms of Service, user terms, ads, and other operating rules ("User Agreements") modified and updated by OKX from time to time and comply with these eligibility conditions. The determination of compliance will be at the sole discretion of OKX.
__1.2. Restricted Jurisdictions. Lucky draws are not available to residents of or located in the following jurisdictions: Cuba, Iran, North Korea, Crimea, Malaysia, Syria, Bahamas, Canada, Netherlands, United Kingdom, India, Brazil, Bangladesh, Bolivia, Donetsk, Luhansk, Malta, El Salvador, Ukraine, and Uzbekistan (collectively, "Restricted Jurisdictions"). By accessing the lucky draws, you represent and warrant that you are not a resident of or located in any Restricted Jurisdiction at the time of accessing the lucky draws. You acknowledge that lucky draws are subject to certain geographical restrictions and may not be available in your area, and that all related assets will be offered only in regions determined by OKX at our sole discretion.
1.3 Ineligible Parts. OKX, its parent company, affiliates, subsidiaries, promotional agencies, sales representatives, and each of their respective directors, officers, employees, and assignees (collectively, the "Promotional Parties") are not eligible to participate in the Lucky Draws or win a reward. This also includes any immediate family members and/or those living in the same household (whether related or not). For the purposes of this Agreement, a "family member" includes any spouse, partner, parent or stepparent, legal guardian, parent-in-law, grandparent, children or stepchildren, siblings or stepsiblings, and grandchildren.
1.4 Additional Eligibility Criteria and Changes to Rules. Please note that additional rules and eligibility criteria may be announced through other channels, such as OKX Argentina's Instagram account, OKX Latam's Telegram channel, OKX Latam's YouTube channel, or OKX Latam's X account. OKX reserves the right to change the terms of the Lucky Draws at any time at its discretion. Furthermore, OKX reserves the right to disqualify any participant who shows signs of fraudulent behavior at OKX's sole discretion.
1.5 Legal and Regulatory Restrictions. Lucky Draws are subject to all applicable laws and regulations and are void where prohibited or restricted by law.
2. How to Participate
2.1 Participation in the Lucky Draw is free. The lucky draw will be held on Instagram via the OKX Argentina profile (@okx_argentina), on Telegram via the OKX Latam channel (@okxlatam), on YouTube via the OKX Latam channel (@okxlatam), or on X via the OKX Latam timeline (@okxlatam). Without limiting the foregoing, to be eligible to win the rewards of each lucky draw, eligible participants must complete the procedures set forth in this Agreement and other user agreements, including but not limited to the following:
Participation on Instagram:
Follow the relevant OKX account with the participant's personal Instagram account.
Complete the required tasks in the corresponding post on OKX's social channel.Telegram Participation:
Follow the relevant OKX account with the participant's personal Telegram user.
Complete the required tasks in the corresponding post on OKX's social channel.YouTube Participation:
Follow OKX's relevant account with the participant's personal YouTube account.
Complete the required tasks in the corresponding post on OKX's social channel.Participation on X:
Follow the relevant OKX account with the participant's personal X account.
Complete the required tasks in the corresponding post on OKX's social channel.
2.2 Limitations of Participation. Limit of one (1) entry per individual during the Lucky Draw Period (as defined below). Any entry received from any individual in another account, or that attempts to create an additional account, during the Lucky Draw Period will be disqualified. Any attempt by a participant to obtain more than the stated number of entries using multiple and/or different email addresses or any other method will void all entries from that participant, and that participant may be disqualified. The use of any automated system to participate is prohibited and will also result in disqualification. Should a dispute arise regarding the identity of a potential winner, the entry will be deemed to have been submitted by the authorized owner of the email account associated with the participant's OKX account (“Participant's Email Address”). The potential winner may be required to provide sufficient identification to demonstrate that they are the authorized owner of the applicable email account. For the purposes of this section, the "authorized account owner" is the natural individual assigned to the applicable email account. Proof of submission of an entry does not constitute proof of delivery.
3. rewards. The prize ("Prize") will be as described in the corresponding social media post published by any of the social media channels stipulated in 2.1 (the "Lucky Draw Post"). No cash alternative will be offered. The rewards are not transferable, and no substitutions will be made except as provided in this Agreement and at the sole discretion of OKX. The rewards consist solely of the items specifically listed and described as part of the Reward. No more rewards than those established will be awarded. OKX brand or sub-brand merchandise rewards, or any other brand from its sponsorships, affiliates, and sub-affiliates, may vary and may not always be specified in the lucky draw publication. The cryptocurrency token rewards and the exact quantity of tokens awarded will be based on the token exchange rate on the OKX platform at the time the reward is credited to the winner's account.
4. Lucky Draw Period. The lucky draw will take place during the time specified in the Lucky Draw Post (the "Lucky Draw Period").
5. Winner Selection
5.1 Winner Selection. The winner(s) of the lucky draw will be selected as described in the lucky draw post from among all eligible entries received within the lucky draw period.
5.2 OKX Confirmation is Final and Binding. OKX will select the winner(s) within 15 days from the end of the Lucky Draw Period. The selection of the winners will be final and binding.
6. Winner Notification and Prize Claim
6.1 Potential Winner Notification. The winner is responsible for ensuring they can accept the reward as stated and in accordance with this Agreement. Potential winners will be notified through their social media account by an OKX representative with instructions on how to claim their rewards. To remain eligible to claim their reward, potential winners must respond to this message within 24 hours.
6.2 Requirements of the Potential Winner. If a potential winner cannot be contacted, fails to respond to the email within the allotted 48 hours, or declines the reward, or if a reward and/or reward notification is returned as undeliverable, the potential winner will be disqualified without prior notice and an alternate winner may be selected.
6.3 Reward Compliance. The reward distribution will be made within thirty days from the verification of the winner. OKX is not responsible for undelivered emails resulting from any form of active or passive email filtering by a participant's email or insufficient space in the participant's account to receive emails. Instances such as these will be considered a loss of the prize, and no compensation will be granted. OKX will have no further obligations towards the participant in such cases.
6.4 Transfer or Substitution Stipulations. The rewards are not transferable, and no substitutions will be made except as stated in these rules and at the sole discretion of OKX. OKX reserves the right to substitute a reward with one of equal or greater value if the designated reward is unavailable for any reason. The rewards consist solely of the items specifically enumerated in the lucky draw posting and described as part of the Prize. In no case will more rewards than those established be awarded.
6.5 Non-Deliverable Rewards. The details of the reward not specifically stated in these rules will be determined at the sole discretion of OKX. OKX is not responsible and will not replace any undeliverable rewards or any lost, damaged, or stolen rewards or components of a reward.
7. Tax and Shipping Concerns. OKX will send the reward through the shipping service it deems appropriate and the winner will be responsible for all applicable taxes.
8. Representations and Warranties. OKX makes no representations or warranties regarding the lucky draw.
9. Disclaimers and Limitations of Liability
9.1 Limitations of Liability. To the maximum extent allowed by law, any liability not expressly provided herein will be disclaimed by OKX, except those established in Consumer Protection Law 24,240, in relation to the Reward offered. In no event shall OKX, its directors, members, officers, employees, or agents be liable for any special, indirect, or consequential damages, or any other damages of any kind, whether in an action of contract, tort (including but not limited to negligence), or otherwise arising out of or in any way connected with the promotion, including, without limitation, any damages caused by or resulting from any participant's reliance on any information obtained from OKX, or resulting from errors, omissions, interruptions, delays in operation or transmission, or any failure of performance, whether or not resulting from an event of force majeure, communications. OKX, its directors, members, officers, employees, or agents shall be limited in their liability, whether individually or collectively, to ten United States dollars ($10 USD).
9.2 No Liability. No third party company is a promoter of this lucky draw or accepts any responsibility in relation to the lucky draw, the competition or any reward, nor for indirect, special or consequential losses or damages, nor for injuries or damages arising from the use of the rewards.
10. Applicable Law and Dispute Resolution
10.1 Applicable Law. Participants agree that in order to participate in the Lucky Draws, any and all claims, disputes and causes of action of any kind or nature arising out of or related to the Lucky Draws, directly or indirectly, shall be governed by and construed in accordance with the laws of England and Wales without regard to any principle of conflict of laws.
10.2 arbitrage. This Agreement is governed by and shall be interpreted in accordance with the laws of England and Wales. Any dispute or claim arising out of or related to this Agreement will be subject to binding arbitrage administered by the London Court of International Arbitration (“LCIA”). LCIA arbitrage shall take place in London, England, before a sole LCIA arbitrator, who shall be a retired judicial officer. The parties will bear their own attorneys' fees and arbitration costs unless the arbitrator rules otherwise. The parties will equally split the fees and expenses of the LCIA arbitrator. The LCIA arbitration shall be governed by the LCIA Arbitration Rules, as modified by this Agreement. Dispositive motions will be allowed, and the arbitrator must follow this Agreement, will have the same power to award damages and relief as a court (including reasonable attorneys' fees and costs), and will issue a binding written decision, which may be triggered by the entry of a judgment by any competent court.
10.3 Limited Discovery. Participants agree that OKX will not be obligated to provide general document discovery but may be required to produce only specific, identified documents that are relevant and material to the outcome of the Dispute.
__10.4 Final and Binding Nature. Any arbitration award shall be final and binding upon the parties and shall be enforceable in any court of competent jurisdiction.
__10.5 No Class Action or Litigation. Participants agree to resolve any and all disputes with OKX on an individual basis through arbitrage rather than as part of any class action or representative litigation.
__11. OKX Privacy Policy. Any and all information provided by participants is subject to the OKX Privacy Policy. By participating in the lucky draw, you grant OKX permission to share any personal identification information for the purpose of prize administration and fulfillment.
12. Social Network Disclaimer
12.1 Social Network Account. Please note that an Instagram, YouTube, X, and/or Telegram account may be required to participate.
__12.2 Stipulations Regarding the Social Networks Platform. The lucky draws are not sponsored, endorsed, associated with, or administered by Instagram, YouTube, X, or Telegram.
12.3 Required Information. All participants understand and agree that they are providing their information to OKX and not to Instagram, YouTube, X, or Telegram.
13. Miscellaneous
13.1 Full and Complete Understanding. All relevant terms and conditions, user agreements, policies, rules, and announcements (as amended, supplemented, and updated from time to time) published on the OKX website constitute the complete and entire understanding and agreement between you and OKX regarding this Lucky Draw.
13.2 New Notices, Ads, and Updates. OKX may publish more ads with more details regarding the Lucky Draws from time to time at its sole discretion as it deems appropriate. Please carefully read and review these notices, ads, and updates related to or about the lucky draws to be eligible to win rewards offered in the lucky draws. Your continued participation in the Lucky Draw(s) after being notified of these changes constitutes your acceptance of the relevant ads.
13.3 Right to Change or Modify. OKX reserves the right to exclude any participant from the lucky draws without prior notice and to cancel this lucky draw without prior notice, at its sole discretion.
13.4 Final Decision and Interpretation. OKX reserves the right to interpret the Terms of the Lucky Draw as it sees fit, and reserves the right to change or modify these Terms at any time at its sole discretion.
